Finially

It took a few more emails (I had to have the specific language "penalty of perjury" under #6 etc ) but the listing is finally down. The shop is still open of course.

I should have known what was coming when the email is "legal@etsy". Lawyers, you gotta love them. *sigh* Clearly Etsy is more concerned with covering their butt than maintaining real quality control on their sellers. I guess I understand the need for all the legalize but as a consumer I'll be far more wary of any seller I don't already know and extremely reluctant to give my money to this company that as an innocent victim made me FEEL stupid and a nuisance.

So if you ever have to report a copyright violation to Etsy email me - I'll let you know what to say and save you my pain... Oh don’t expect any kind of acknowledgement of the complaint or notification that the copyright violation was taken care of – I had to look up the listing to see if it was down.

Anyway, moving on…

ETA:
I did get an acknowledgment (another form letter) from ETSY that my "Allegation of Infringement" was acceptable and that the listing had been taken down... 26 hours after my last email was sent to them and about 16 hours after the listing was gone (I don't know exactly when it was taken down, that is just when I checked). I guess I'll give them the benefit of the doubt and just assume they are THAT backlogged with copyright violations. Still they won't be getting an A+ from me for communication.

Yeah, yeah.

I know. You know I know.

I'm just trying to avoid them right now.

BTW - would now be a good time to inform you that you spelled "finally" wrong?

(don't hurt me)

*whack*

I hate you.

I contacted the Met. I doubt we'll see anything happen until Monday. The Met might email me back -museums tend to be good about that. I also need to contact the Louisiana Museum and warn them. If we get enough people that already have lawyers to go after this will-be-50-in-another-month old woman, then etsy will have to take more action than just taking down certain listings.

:-) If I were really REALLY evil...I'd give our darling MissMellie's phone number out to a few telemarketers.... In India. So they'll call her at two am. However, I'm more upset at ETSY and their lack of service right now. They do have a Twitter account. Maybe it's time for some more tweets...

Yeah it's definietly Etsy that I'm the most upset with. I can't believe they made it that hard and the shop is still in operation. So annoying...

[identity profile] bauhausfrau.livejournal.com 2011-09-30 03:33 pm (UTC)(link)
How freaking annoying! I get to a certain point with things like that and just give up, there's only so much one can take. hugs hon.

[identity profile] jennylafleur.livejournal.com 2011-09-30 04:28 pm (UTC)(link)
Totally! I still can't believe what a pain Etsy was.

[identity profile] fancyfrocks.livejournal.com 2011-09-30 04:05 pm (UTC)(link)
*hugs* I'm glad they finally did something.
It's been a big turn off about Etsy to me, too. I see photos stolen from magazines, etc, ALL the time on there. And that you have to go through so much just to report a listing is ridiculous. On Ebay it's like three things in a form. Seems they're more into supporting a free creative community than protecting people's work. Lamesauce.

[identity profile] jennylafleur.livejournal.com 2011-09-30 04:31 pm (UTC)(link)
Yeah. If the complaint has to be *that* specific they need a form that you can easily find. The whole process was very confusing and took way more of my time than it should have. It's not like this isn’t a major problem on their site. And no wonder if it's that hard to make complaints!

[identity profile] elegant-musings.livejournal.com 2011-09-30 09:08 pm (UTC)(link)
So glad it finally got taken down. Etsy lately has been a bit hit-and-miss for me. I used to love it, but now it's just gotten extremely stupid (too big for it's britches?!) and there are too many sketchy sellers on there. Don't know why that phases me on Etsy in particular (after all, Ebay is notorious for this sort of thing), but I guess it was because it used to feel like a friendly community!

[identity profile] jennylafleur.livejournal.com 2011-10-01 01:25 am (UTC)(link)
Yeah I thought Etsy would handle this situation, and me, differently - if it had been Ebay I would have walked in the situation with more jaded expectations. I think it's because Etsy in the beginning claimed to be different from the other marketplaces. The emphasis on community and being unique and all that. It was good for a while and now they have gotten too popular for their own good I think. I don't know if they have grown too big and don't know how to deal with these type of situations or the decision makers are now making enough money to not be bothered anymore.

Etsy used to be a place I spent a lot of time shopping but no more. Shopping online is always a risk but I had faith that Etsy had some kind of quality control. Not after this experience. It still burns me that this shop is still open after multiple and repeat offences and such a holy heck being raised. Not all scammers are as obvious as this one and yet they won’t act in this instance. Yeah I have zero confidence that Etsy has my back and will protect me or even help if one of their sellers tries to rip me off.

[identity profile] elegant-musings.livejournal.com 2011-10-01 01:20 pm (UTC)(link)
I agree--I haven't been spending as much time shopping on Etsy (aside from not needing to buy more STUFF to just pick up and move! lol.) for a variety of reasons, but this is definitely one of them. I have had too many friends/acquaintances have images stolen from them. Not to mention it's gotten insanely hard to wade through all the listings and find stuff. I don't know... I'll probably still use Etsy occasionally (especially for vintage--I just don't feel like getting into bidding wars anymore. I must be a cranky old lady at this point. ;), but it's getting up there with Ebay for a variety of reasons... :p

Sorry to hear about all this craziness! *hugs* I'm glad Etsy finally took down the listing, but the fact that her shop is still up for the umpteenth time is pretty appalling.

[identity profile] jennylafleur.livejournal.com 2011-10-01 01:39 am (UTC)(link)
Makes you wonder what you have to do to get banned on Etsy doesn't it?

Oh well, hopefully I won't have to deal with something like this again for a good long while.

So sorry this took so long to resolve.

But happy birthday! I hope you had a great day!!
